A defendant shall be punished by imprisonment for not less than one year and six months.

Punishment of the crime

[criminal record] On December 4, 2015, the Defendant was issued a summary order of KRW 1 million for a crime of violation of the Act on the Aggravated Punishment, etc. of Specific Crimes ( drivers' assault, etc.) at the Daegu District Court on the Aggravated Punishment, etc. of Specific Crimes, and on February 15, 2016, the Defendant was issued a summary order of KRW 2 million for the crime of interference with business by the Seo branch branch of the Daegu District Court on February 15, 2016, and was punished six times for violent crimes

[Criminal facts]

1. Since the Defendant, from May 2016 to August 2016, 2016, entered into the “Esing room” operated by the victim D (hereinafter referred to as the “victim D”) in Daegu Seo-gu, Daegu (hereinafter referred to as the “Esing room”) and had been under the influence of alcohol on several occasions, such as taking the victim’s bath and avoiding a disturbance, the victim had a fear against the Defendant.

On August 2016, the Defendant: (a) singing out the instant victim’s singing; and (b) demanded the victim to demand KRW 20,000 to pay the price; (c) “I do so for the same year, there is no money; and (d) in such manner, I would like to be able to engage in funeral; and (d) I expressed the victim’s singing in a large interest.”

As above, Defendant 1 got the victim to have frightened, and caused the victim to have frighten the claim of the above singing rate, thereby acquiring pecuniary benefits equivalent to the above amount.

2. On May 2016, from around 20:0 to around 21:00 to around 21:00, the Defendant: (a) went under the influence of alcohol in the “Esing” operated by the victim D (the age of 58) located in Daegu Western-gu, Daegu-gu; and (b) found the Defendant “Ie this year and singing items.”

“Along with the desire of the victims, the victims expressed in the said singing book, and were forced to interfere with the victims’ work by force over 13 times in total, from that time to February 8, 2017, including by avoiding disturbances for about one hour, such as paying time fees, without any reason, and by force, the victim’s work was obstructed by force.
