A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant, together with C, leased three rooms of Ilyang-gu Seoul Metropolitan City D Office (E, January 9, 2018, when the trade name was “E”, 314, 508, and 914, and after the enforcement, changed the trade name to “F”, 314, 508, and 823) to operate a sexual traffic business establishment.

1. From the beginning of October 2017 to April 17:10, 2018, the Defendant, along with C, operated a commercial sex acts establishment with the trade name “F” (hereinafter “E”), from around October 1, 2017 to around April 4, 2018, and: (a) leased a room room to be used for commercial sex acts; (b) has employed foreigners of Thailand, who are under the name of G (G, towing H), I, J,K, and L as women; (c) placed a commercial sex acts advertisement on “N,” etc., which is a site for arranging commercial sex acts; and (d) Defendant C and M sent a commercial sex acts to women waiting for the said commercial sex acts on behalf of the said women; and (d) the Defendant provided the said commercial sex acts to the said women by operating the commercial sex acts for up to 28 months; and (d) the Defendant provided them with the said commercial sex acts by operating the commercial sex acts on behalf of the said women.

Accordingly, the defendant conspireds with C to arrange sexual traffic for business purposes.

2. Where a foreigner in violation of the Immigration Control Act intends to find a job in the Republic of Korea, he/she shall obtain reasonable sojourn status that allows him/her to work, as prescribed by Presidential Decree, and no person shall employ any foreigner who has no sojourn status that allows him/her to work

Nevertheless, the Defendant, in collusion with C, entered the Republic of Korea as a visa exemption (B1) from December 28, 2017 to January 9, 2018 when operating the said commercial sex acts.
