A defendant shall be punished by imprisonment for not less than one year and six months.

An application filed by an applicant for compensation shall be dismissed.

Punishment of the crime

The Defendant is a person who operated a mobile phone sales store from July 2018 to March 2019 with the trade name of “D” in Suwon-gu, Busan from July 2018 to March 2019.

1. On December 2018, the Defendant forged private documents, such as private electronic records, etc., and the Defendant stated that “A” from the foregoing “D office to “B will run a mobile phone store at home,” “B will only collect the registration of a single customer and return the resident registration certificate.” At around that time, the Defendant received a new female’s resident registration certificate from E at F stores in Busan Metropolitan City Shipping Daegu.

On January 3, 2019, the Defendant used the above resident registration certificate of E, which was possessed by the above D office, to arbitrarily open G mobile phones in the name of E.

The Defendant entered “E” in the subscriber column of “G new application” file stored in a computer, and forged one file of G new application file in the name of E, an electronic media record, such as electromagnetic records concerning rights and duties, with the aim of causing any error in business affairs.

In addition, from the above date to March 11, 2019 to the above date, the Defendant forged electronic records, etc. concerning rights and duties, and forged private documents for the purpose of exercising rights and duties, with a view to making the business affairs smooth over eight times in total, as shown in the annexed crime sight table (1).

2. On January 3, 2019, the Defendant: (a) sent one file of the G new application form in the name of E in the foregoing D office, as described in paragraph (1) at the foregoing D office; (b) exercised a total of eight times from the above date to March 11, 2019, an electronic document recording, etc., in total, from the above date and time to around March 11, 2019, as shown in the list of crimes (1).

3. The Defendant, around January 3, 2019, opened a cell phone from E at the above D office and opened a cell phone from E.
