A defendant shall be punished by imprisonment for not less than one year and six months.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

The defendant is a person who operates a clothing store in the name of ‘‘(D’’ in Busan Central and Medium-gu.

1. Violation of the Trademark Act;

A. On Apr. 30, 2009, the Defendant: (a) from the mid-2009 Police Officer from February 30, 2009 to April 30, 2009, the Defendant supplied the above goods to the Korean Intellectual Property Office (LUIS VUITN, No. 4012539000, etc.); (b) from the intermediate sales stand where the names in the said D stores cannot be known, the Defendant: (c) had been supplied with the trademark registered with the Korean Intellectual Property Office as a bags for the purpose of selling the said goods; and (d) had been supplied with the trademark registered with the Korean Intellectual Property Office as a bags for the purpose of selling the said goods; and (d) had the same quantity as the trademark right holder’s trademark registered with the Korean Intellectual Property Office (LUIS VUTITNN, 400363530000, etc.); and (e) had the same quantity as the trademark right holder’s sale of the said goods.

나. 2013. 2. 13. 범행 피고인은 2013. 2. 13. 16:00경 위 매장에서 이름을 알 수 없는 중간 공급상으로부터 프랑스 `루이비똥말레띠에`사, `샤넬`사, 이탈리아 ‘구치오구치쏘시에떼퍼아찌오니’사, 룩셈부르크 ‘프라다 에스.에이’사, 네덜란드 '카르티에 인터내셔널비.부이‘사, 이탈리아 '불가리 쏘시에떼 퍼아 찌오니‘사, 프랑스 '헤르메스 앵떼르 나씨오날‘사, 이탈리아 ‘살바토레 페라가모 이탈리아 에스.피.에이’사, 이탈리아 ‘가도 에스.알.엘’사, 룩셈부르크 ‘보테가베네타 인터내셔널 에스.에이.알.엘’사가 대한민국 특허청에 그 지정상품을 가방, 선글라스, 목걸이, 구두 등으로 정하여 등록한 ‘루이비똥(LOUIS VUITTON, 등록번호 제4001255390000호 등)', '샤넬(CHANEL, 등록번호 제4000713240000호 등)', ‘구치(GUCCI, 등록번호 제4000703520000호)’, ‘프라다(PRADA, 등록번호 제4003502060000호 등)','까르띠에 CARTIER, 국제등록번호...
