A defendant shall be punished by imprisonment for a term of one year and ten months.
Reasons
Punishment of the crime
[Criminal Records] On February 8, 2017, the Defendant was sentenced to one year and eight months of imprisonment for the charge of forging official documents at the Daegu District Court on February 8, 2017, and the said judgment became final and conclusive on February 16, 2017.
[2] The Defendant: (a) discovered that it is difficult to obtain a high-amount loan of KRW 12,00,000,000,000 won as security under the above D Manyman-gu 205, Daegu-gu, Daegu-gu, 2016, which was leased to C; (b) the Defendant prepared a real estate lease agreement by reducing the deposit; and (c) intended to obtain a loan by means of submitting it to the financial institution.
1. On April 16, 2012, the Defendant forged private documents: (a) without authority, stated in the column of the real estate lease contract for the purpose of exercising the right at a location unclaimed; (b) stated in the column of the deposit “this million won”; (c) the rent in the column of the lessee; and (d) held at will any discretion, following the name of C.
C has forged one copy of the real estate lease agreement in the name of C, a private document on rights and obligations, by sealing C’s seal.
2. On April 16, 2012, the Defendant: (a) filed an application for a loan of KRW 120 million with the East-gu Saemaeul Cooperative, Daegu-gu, Daegu-gu, for a loan of KRW 95,00,000,000; and (b) exercised the said forged real estate lease contract as if the said contract was duly formed.
3. On April 16, 2012, the Defendant: (a) issued a forged real estate lease agreement to a person in charge of the loan to the location in the same manner as paragraph (2) at the victim Leecheon-gu Saemaeul Credit Cooperatives, Daegu-gu, Daegu-gu, which was 95, and (b) obtained a delivery of KRW 120 million from the damaged person as a loan; and (c) obtained it from the damaged person as the loan.

4. The Defendant’s multi-family house in Daegu Suwon-gu E, the Defendant owned, corresponds to the market price by the third creditors.
