A defendant shall be punished by imprisonment for not more than ten months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. Around August 2012, the Defendant committed an indecent act by force against a female by force, such as drinking the victim E (the victim 25 years of age) who is working partner in the liquor called “D” located in “D,” at the end of 02:00 on August 2012, 20, and 7 years of age, and drinking the victim, standing in the side of his/her female, leaving the victim’s mind to commit indecent act by force.
2. 2012. 10. 중순경 강제추행 피고인은 2012. 10. 중순 10:30경 원주시 C에 있는 F 축산물 대형 냉장고 안에서 피해자 E(여, 25세)와 같이 근무 하던 중, 피해자를 강제추행 할 마음을 먹고, 그녀의 뒤에서 허리를 감싸 안으며 몸을 밀착시키고 손으로 배 부위를 만지고, 귓불을 만지는 등 그녀를 강제로 추행하였다.
3. 2013. 5. 22.경 강제추행 피고인은 2013. 5. 22. 15:00경 원주시 C에 있는 G클럽에서 직장동료들과 회식을 하면서 피해자 E(여, 25세)가 다른 동료들과 같이 노래를 부르며 춤을 추고 있을 때 피해자를 강제추행 할 마음을 먹고 그녀의 뒤에서 몸을 밀착하고 귓속말로 “E야 너 가슴한번 만져 봐도 되니” 라고 말을 한 다음 이에 피해자가 거부하였음에도 불구하고 손으로 피해자의 가슴을 만지는 등 그녀를 강제로 추행하였다.
4. At around 08:40 on July 30, 2013, the Defendant committed an indecent act by force against a female by force, on the part of the victim E (hereinafter “the victim E”), who took rest in the rest room of F 4th floor in the original city C, around July 30, 2013, at around 08:40, the Defendant committed an indecent act against the female by force by force, including: (a) the victim E (hereinafter “the victim would be able to commit indecent act by force; (b) the victim would be able to commit suicide at any time; and (c) the victim would be able to commit an indecent act by force.
5. On July 30, 2013, the Defendant, at around 09:00, drinked by indecent act by compulsion, around July 30, 2013, the Defendant drinked the victim E (the 25-year-old age) in front of the Plaintiff, at around 09:0 on July 30, 2013.
