A defendant shall be punished by imprisonment for one year.

However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment became final and conclusive.

Punishment of the crime

피고인은 말레이시아 국적으로, 2015. 11. 4. 경 말레이시아 쿠알 라 룸 프 이하 불상지에서 인터넷 위챗으로 알게 된 성명 불상자( 위 챗 대화명 ‘C’ )로부터 ‘ 위조신용카드로 한국에서 물품을 구매해 말레이시아로 가져다주면 그 대가로 2,000 링 깃( 한화 약 55만 원 상당) 을 주겠다.

피고인은 2015. 11. 8. 경 위챗을 통해 ‘C ’로부터 서울 중구 D에 있는 E 백화점 본점에 가서 위조신용카드로 물품을 구입하라는 지시를 받고, 같은 날 17:40 경 E 백화점 본점 1 층 F 매장에서, 8,450,000원 상당의 물품을 구매하면서 위조사실을 모르는 위 매장의 성명 불상 종업원에게 피고인 명의로 위조된 캐나다의 ‘Bank of Montreal' 사가 발급한 신용카드( 번호 : G)를 마치 진정한 신용카드인 것처럼 제시하여 위 종업원으로 하여금 매출 전표를 작성하게 한 다음 그 매출 전표에 서명하여 교부하고, 이에 속은 위 종업원으로부터 8,450,000원 상당의 물품을 교부 받았다.
