A defendant shall be punished by imprisonment for not less than two years and six months.

Punishment of the crime

The Defendant and C forged the E’s resident registration certificate and the lease agreement on the instant real estate, the owner of the land and buildings located in Seocho-gu Seoul Metropolitan Government (hereinafter collectively referred to as the “instant real estate”), which are the owners of the said real estate in Seocho-gu, and conspired to obtain the purchase price of the said real estate from the purchaser by pretending that C would sell the said real estate normally.

1. On January 2007, the forgery C of public document, without authority, has forged one resident registration certificate under the name of the head of Seocho-gu Seoul Metropolitan Government head of Seocho-gu Seoul Metropolitan Government, by attaching his/her photograph to the right upper corner of the resident registration certificate stated as “the resident registration certificate, E, F, Seocho-gu Seoul Metropolitan Government G apartment302, March 17, 200,” with the intention of exercising it in accordance with the above public offering.

Accordingly, the defendant conspireds with C to forge an official document.

2. On May 18, 2007, the Defendant, as the above 1. Around May 2007, sent C with a forged resident registration certificate, and instructed C to be issued the “actual condition of the registered matters, etc.” with respect to the instant real estate at Seocho Tax Office, and C, upon the Defendant’s instruction, presented a forged E’s resident registration certificate, which was presented to an employee of the above tax office, who is unaware of the forgery, in order to apply for “actual condition of the registered matters, etc.” with respect to the instant real estate owned by E in Seocho Tax Office located in Seocho-gu Seoul, on May 18, 2007.

Accordingly, the defendant used a forged official document in collusion with C.

3. On June 4, 2007, the Defendant’s uttering of forged official document and fraud are placed in the J (K prior to the name of the company) of the I Licensed Real Estate Agent Office in Gangnam-gu Seoul, with the instant real estate as a movable property, and C received a “current status of registered matters, etc.” concerning the instant real estate as stated in the above 2., and the status of lease as stated in the “Status of Registered Matters, etc.”.
