1.(a)

Defendant A Co., Ltd. is the Plaintiff H, Defendant B Co., Ltd. is the Plaintiff I and J, and Defendant C Co., Ltd. is the Plaintiff.

Reasons

1. Basic facts

A. The Defendants are companies running urban bus transportation business, and the Plaintiffs are drivers who were or were working for each of the pertinent Defendant companies listed in the “affiliated Company” column in the “Date of Admission, Retirement, Claim and Acceptance Notice” column in attached Form 2. 2) Plaintiffs and T, U, V,W, X, Y, Z, AAB, AB, and AC respectively retired from Defendant D Co., Ltd (hereinafter “Defendant D”) on each of the corresponding dates indicated in the “Date of Withdrawal” column in attached Form 2.

B. The main contents of the collective agreement and wage agreement are as follows: (a) labor relations between the Plaintiffs and the Defendants are determined by collective agreement and wage agreements entered into between the BD Group BE branch (hereinafter “trade union”) to which the Plaintiffs belong and the BF business cooperative to which the Defendants belong (hereinafter “business cooperative”). The main contents of the collective agreement and wage agreement from 2009 to 2012 are as follows.

1) The working system and working hours per day shall be two educational programs per day; the shift working hours after A.M. and after E.M. shall be based on 14:30; the number of working days per month shall be 22 days per basic working day (20 days for February and 21 for leap year) and 24 days per extended working day (22 days for February and 23 days for leap year).

B) Work hours are 8 hours a day’s basic work, 1 hours a week’s basic work, 40 hours a week’s basic work, 5 hours a week’s overtime work, and 9 hours a day’s overtime work in the case of an extended work day (one of the hours is overlapping at night).

The completion of working hours shall be made up to the time of retirement from the company after completing the operation pursuant to the dispatch table in order to ensure that it does not interfere with the operation of the dispatch table.
