A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. On December 17, 2008, the Defendant received a summary order of KRW 700,000 from the Busan District Court to a fine of KRW 1,50,000 as a crime of violating the Road Traffic Act, and a summary order of KRW 1,50,000 as a fine of KRW 1,50,000 as a crime of violating the Road Traffic Act from the Chungcheong District Court on September 29, 2017.

At around 22:50 on February 13, 2020, the Defendant driven a Brenice car under the influence of alcohol concentration of approximately 0.208% from the section of about 30 km from the front of the main station in Scheon-dong, Sacheon-gu, Cheongju-si to the front road of the bus stops of the Cheongju-si, Seoul Metropolitan City.

2. No driver of any motor vehicle, etc. who has violated the Road Traffic Act shall threaten or endanger any other person, or cause any danger to traffic, by repeatedly committing any violation of signal or instruction or by committing a central line, or by continuing or repeating any one act;

Nevertheless, from 22:50 on February 13, 2020 to 23:02 on the same day, the Defendant, without disregarding the demand of the head of the police station affiliated with the Cheongju-gu Police Station C District, which was called up after receiving a report on the suspicion of drunk driving, proceeded with the red signal signal of the signal apparatus at the exit of the head of the Cheongju-gu Police Station C Zone C District, which was called up after receiving a report on the suspicion of drunk driving, in contravention of the demand of the head of the Cheongju-gu Police Station C District, and proceeded with the red signal signal of the signal apparatus at the exit of the head of the vehicle and the shooting distance between the head of the Gu and the head of the Gu.

As a result, the Defendant committed a violation of signal or prohibition of instruction, a violation of central line invasion, etc., or committed a threat or danger to others or a danger to traffic by continuing or repeating a single act.
