A defendant shall be punished by imprisonment for two years.

1. On November 21, 2016, the Defendant: (a) withdrawn KRW 60,000 in cash from the cash payment machine established at the location located in the Dong-dong branch of the Busan Bank, Suwon-ro No. 591, Suwon-gu, Busan, Busan, and then acquired one copy of the cash card in the name of D on the cash payment date; and (b) obtained one copy of the cash card in the name of D.

In addition, from November 8, 2016 to December 27, 2016, the Defendant acquired the cash cards and credit cards of the victims on five occasions as shown in the annexed crime list (1) and did not take necessary procedures, such as returning them to the victims, and embezzled as he/she thought he/she had.

2. Attempted larceny;

A. On November 8, 2016, the Defendant confirmed that the password was entered on the back of the Busan Bank’s cash card in the name of D, which was acquired as at the end of the first half of the year in the annexed crime list (1) in order to withdraw cash from the account, and attempted to theft by inserting a password and withdrawing cash. However, the Defendant attempted to commit a shortage in the balance and attempted to commit a crime.

B. On November 28, 2016, around 17:47, the Defendant attempted to steal the above debit card by arbitrarily putting it in the cash payment season and withdrawing cash in order to withdraw cash from the account using the debit card of the Busan Bank under the name of the E, which was acquired, such as the victim bank in the name of the Busan Bank, prior to the cash payment period for the current branch cash payment period managed by the Busan Bank, which was 30, Seo-gu, Busan. However, the Defendant failed to withdraw cash due to an error in the password and attempted to do so.

On December 4, 2016, the Defendant, at around 20:46, obtained E, as shown in the attached crime sight table (1) 2 times in the instant case, prior to the cash payment at a branch of the year managed by the Busan Bank, which was located in 144, from the Busan Bank.
