Reasons
Punishment of the crime
1. A subsidy for the project for modernization of livestock shed facilities implemented by Defendant B, C, and A, which had been implemented by the joint-crime group, was granted to those engaged in the livestock farming industry before January 1, 2006, for those engaged in the livestock industry after the application of the subsidy. Among the seven buildings used by Defendant A while the two areas, one building was registered before January 1, 2006, and one building was remodeled after the completion of the registration of the livestock industry and after the application of the subsidy. The remaining six buildings were not registered before January 1, 2006, and the livestock industry was not registered before the application for the subsidy was made, but the renovation and repair project was not made after the application for the subsidy.
Defendant
A knew that all renovation construction works for the above seven Dongs are not eligible for the above subsidy, but around December 201, after finding in the office of the M&D company located in Seo-gu, Seo-gu, Gwangju L 4th, Gwangju around December 2, 2011, the Defendants, who were the operators of the above company B and C, conspired to receive subsidies in the name of the K&D company M&A and to transfer the said documents to the account in the name of the defendant B and C, the operator of the above company, who supplied or executed the construction work not eligible for the above subsidy, or to receive false tax invoices received from P, who sold or executed the construction work not eligible for the above subsidy. The defendant B and C prepared a false construction contract standard contract in accordance with the above false tax invoice, and submitted the above documents around that time to Q, the public official account of the Sung-gun-gun Office, the person in charge of the above subsidy project, and received subsidies in the name of the K&D company.
2. A subsidy granted for the modernization work of the livestock shed facilities at Defendant B, C, and D’s joint criminal conduct shall have a construction business license.
