Reasons
Punishment of the crime
1. Violation of the Wastes Control Act;
A. Defendant A, B, C, and D’s co-principal act is the representative director of E Co., Ltd. (hereinafter “E”), a aggregate production company, and Defendant B is the co-principal of Defendant A, a person running the E with Defendant A from October 2010. Defendant C is a person who registered his/her business with the trade name “L” in the name of the wife K and engages in the transportation business, and Defendant D is a private land producer who sets up land with the consent of land owner with the trade name of “M”.
Defendant
A requested the Defendant C to transport inorganic sludge, which is the commercial waste generated in the course of the production of aggregate from January 2009 to reduce waste treatment costs. From October 2010, Defendant B requested the Defendant C to transport inorganic sludge, which is the commercial waste generated in the course of the production of aggregate from around October 2010, along with the Defendant A. Defendant C used a dump truck of 15 tons of L from January 2009 to E’s surrounding farmland, and Defendant D conspired to embling in inorganic sludge without permission by means of dumping the above inorganic sludge with the consent of the owner of the above farmland from January 209 with the Defendant’s bump truck from around January 209.
No person shall reclaim industrial wastes in any place other than a waste disposal facility permitted, approved, or reported.
Nevertheless, Defendant A, C, and D conspired as above from January 2009 to June 2013, in collusion with Defendant A, C, and D to reclaim in the manner of filling the inorganic contamination, which is the commercial waste, from 14,740 cubic meters from January 2009 to July 19, 2013, as shown in the List of Crimes 1 (the current status of reclamation), the inorganic contamination 207,000 cubic meters from January 1, 2009 to July 19, 2013, and the Defendant B buried the same as the list of crimes 1,00 cubic meters from July 1, 2013 on the land located in the city of Heung-si.
