1. The Defendant shall pay to the Plaintiff KRW 40,00,000 and the interest rate of KRW 20% per annum from December 12, 2014 to the date of full payment.

Comprehensively taking account of the purport of the entire arguments in Gap evidence Nos. 1 through 3, it is recognized that the plaintiff lent KRW 40,000,000 to the defendant around October 20, 201 by fixing the maturity of the payment and KRW 750,000 per December, 201. According to this, the defendant is liable to pay to the plaintiff 40,000,000 and damages for delay calculated at the rate of 20% per annum under the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings from December 12, 2014 to the date of full payment, as requested by the plaintiff.

In regard to this, the defendant alleged that there was an agreement between the plaintiff and the plaintiff to pay KRW 10,000,000,000, which is around March 2014, to liquidate the above loan obligation, but there is no evidence to acknowledge it. Thus, the defendant's above assertion is without merit.

Therefore, the plaintiff's claim is justified and it is so decided as per Disposition.
