1. The Defendant shall pay to the Plaintiff KRW 40,00,000 and the interest rate of KRW 20% per annum from October 17, 2014 to the day of full payment.

Comprehensively taking account of the purport of the entire arguments in the statement No. 1-1 and No. 2 of the evidence No. 1-2, the Defendant agreed to pay the Plaintiff the construction cost of KRW 40,000,000 by August 31, 2014.

According to the above facts of recognition, the defendant is obligated to pay to the plaintiff the above 40,000,000 won and damages for delay calculated at the rate of 20% per annum from October 17, 2014 to the day of full payment as requested by the plaintiff, which is the day following the delivery of the payment order in this case.

Therefore, the plaintiff's claim of this case is reasonable, and it is decided as per Disposition by the assent of all participating Justices.
