The judgment of the court below is reversed.

Defendants shall be punished by imprisonment for ten months.

1. The summary of the grounds for appeal (misunderstanding the facts) was aware that they could not receive the right to sell commercial buildings as compensation for their livelihood, and the Defendants could have the right to sell commercial buildings by deceiving such victims.

It is the fraud of the money.

Nevertheless, the lower court found the Defendant not guilty of the facts charged of this case. The lower court erred by misapprehending the facts and adversely affecting the conclusion of the judgment.

2. Before the judgment on the grounds for appeal by the defendant ex officio, the prosecutor applied for changes in indictment with the contents of the facts charged as stated below in the judgment of the court below. Since this court permitted this, the judgment of the court below was no longer maintained.

3. In conclusion, the judgment of the court below is reversed pursuant to Article 364 (2) of the Criminal Procedure Act without examining the prosecutor's argument on the ground that the above ground for reversal exists ex officio, and the judgment of the court below is reversed, and it is again decided as follows.
