3. 폭력행위등처벌에관한법률위반(집단ㆍ흉기등상해) 피고인은 2013. 8. 16. 05:20경 인천 남동구 H에 있는 길에서 술에 취하여 길을 걷다가 마주오는 피해자 I(남, 24세)을 보고, "너 이새끼야 젊은 놈이 뭐야."라고 소리치며 갑자기 주먹으로 피해자의 얼굴을 수 회 때리고, 쓰러진 피해자의 얼굴을 주먹과 발로 수회 때리고 걷어찼다.

계속하여 주변에 있던 위험한 물건인 가로수 나뭇가지(길이 약 1m 정도)를 꺽어 손에 들고 피해자의 머리를 수회 내리쳤다.
