A defendant shall be punished by imprisonment for not less than one year and six months.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

As the Defendant was living together for about four months with the victim B (or 28 years of age) and about four months, the Defendant heard that the Defendant would not be able to operate the “C”, which is the main point for the Defendant to prepare for the victim from the victim, and made a dispute.

1. On December 7, 2018, at around 05:50 on the front side of the “E” restaurant located in Gwangju-si, Gwangju-si, Gwangju-si, the Defendant left the victim’s arms by entering the victim’s arms and demanded the victim to get off, but at around 07:30 on the same day, the Defendant detained the victim by driving approximately 100 km at a speed of about 90 km from the 90km to the roads adjacent to the Hancheon-si, Chungcheongnam-si Highway at approximately 00 km, and opened a door to the victim “I will die, I will die, I will die, I will die, and I will soon see what I will see.”

As a result, the defendant detained the victim for about one hour, thereby committing harsh acts.

2. Around 05:50 on December 7, 2018, the Defendant: (a) sent the victim to the “H” in the front of the above “E” restaurant; and (b) moved the victim to the “H” in the North-gu Seoul metropolitan city G, Gwangju.

계속하여 피고인은 위 H에서 위 차량을 타고 있던 피해자를 향해 “꼼짝하지 말고 있어라, 부셔 버릴 테니까”라고 말하고 그곳에 있던 위험한 물건인 굴삭기의 운전석에 올라타 굴삭기의 시동을 거는 듯한 행동을 하여 피해자로 하여금 겁을 먹게 하였다.

Accordingly, the defendant carried dangerous objects and threatened the victim.

3. On December 7, 2018, the Defendant violated the Road Traffic Act ( sound driving) from around the main point of “C” in the operation of the victim located in Gwangju Mine-gu, Gwangju, to the roads adjacent to the Southern Sea Highway, 07:50 on the same day via the above E and the above H around 07:50 on the same day.
