A. A. Around March 30, 2013, the Defendant, against the victim B, posted a false statement stating that “Aphone is sold” on the Internet NAV “E” on the Internet NAC located in Do Government-si C, and then sent a false statement to the victim B who contacted the Defendant “275,000 won if transferred to the Defendant.”

However, there was no intention or ability to send the money to the victim even if the money is transferred from the victim because the defendant did not have the above opon.

Nevertheless, the Defendant deceivings the victim as above, and acquired 275,000 won as sales proceeds from a corporate bank account in F on the same day from the victim, around 08:39 on the same day.

B. Around April 10, 2013, the Defendant, against the victim G, posted a letter stating that “The Defendant sells an Aphone 532G” in the said “DPC” on the said “ECC”, and made a false statement to the victim G who contacted the Defendant, stating that “The Defendant will send 300,000 won to the Defendant.”

However, there was no intention or ability to send the money to the victim even if the money is transferred from the victim because the defendant did not have the above opon.

Nevertheless, the Defendant deceivings the victim as above and acquired 300,000 won as sales proceeds from a corporate bank account in the above F on the same day from the victim, at around 13:03 on the same day.

Except as otherwise provided for in any other Act, no one shall arrange for the transfer of any means of access used in electronic financial transactions.

Nevertheless, on March 15, 2013, the Defendant, at a non-governmental place (hereinafter referred to as the "Gui-si") and the Busan Bank Account (Account Number H) and the Bank Account (Account Number I) opened in the name of F in the name of F through express buses, together with each passbook and check card.
