A defendant shall be punished by imprisonment for not less than one year and six months.

Punishment of the crime

On November 16, 2017, the Defendant was sentenced to imprisonment with prison labor at the Seoul Northern District Court for a crime of fraud. On June 1, 2018, the Defendant completed the execution of the sentence in the Chuncheon Prison on June 1, 2018.

On June 10, 2018, the Defendant posted a false statement on the Internet B C Kapet bulletin board, stating that “The Defendant will send a DNA pocket ticket if he remitted KRW 300,000 to the victim E (hereinafter referred to as “the age of 29”) who reported and contacted such a statement.”

However, since the defendant did not have a DNA ticket, even if he received money from the victim, he did not have the intention or ability to send a DNA ticket to the victim.

Therefore, around June 10, 2018, the Defendant received 300,000 won from the victim’s bank account (Account Number: G) in the name of the Defendant and received KRW 4,832,00 from the victims in total on 34 occasions from around that time to October 22, 2018, as shown in the attached crime list.

On October 8, 2018, the Defendant posted a letter on the Internet B PCbook in Busan J, Busan, stating that “The sale of J-Public Performance PPPet” in the Internet BC page, and made a false statement to the victim K who reported and contacted the above, stating that “The Defendant will transfer money and send the ticket.”

However, even if the defendant did not have the above diskettes and received money from the victim, he did not have any intention or ability to send the above diskettes to the victim.

On October 9, 2018, the Defendant, by deceiving the victim, received 309,200 won from the L Bank Account (M) in the name of the Defendant around 09:00 on October 9, 2018.
