A defendant shall be punished by imprisonment for one year.

Punishment of the crime

The Defendant committed the following crimes in a state that the Defendant had the ability to discern things or make decisions due to stimulative disorder and alcohol dependence.

1. Interference with business;

가. 피고인은 2014. 11. 1. 14:00경 논산시 C에 있는 ‘D주점’에 들어와 안에 있던 손님들에게 “형님, 담배사게 2,000원만 줘요.”라고 말하였고, 이에 위 ‘D주점’의 업주인 피해자 E이 나가라고 하자 “씨발 년, 좃같은 년, 죽여버린다.”고 말하며 빈 소주병을 탁자에 내리치고 ‘불을 질러 버리겠다’고 하며 소란을 피우는 등 약 1시간에 걸쳐 위력으로 피해자 E의 주점 영업 업무를 방해하였다.

B. C. At around 17:00 on November 4, 2014, the Defendant found the G store located in Seosan City F, and obstructed the victim H’s agency business for approximately 20 minutes by finding the victim H as “the victim’s mobile phone was lost.” The victim H returned to approximately 15 minutes of the mobile phone without any reason, and going to the victim H using the mobile phone blicking out of the off, with the victim H, with the phone blicking the phone from the victim, thereby interfering with the victim H’s agency business for about 20 minutes, including: (a) how you want to take the phone; (b) how you want to take the phone; (c) how you want to take the phone; and (d) how you want to take the phone.”

2. The Defendant, on October 29, 2014, expressed an intention or ability to pay taxi charges from the distance of psychological affairs in the Si/Eup/Myeon, Masan-si on October 23, 2014.
