A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Indecent acts by compulsion;

A. At around 18:40 on October 11, 2014, the Defendant entered the E entertainment tavern operated by the Victim D (Min, 40 years of age) of Jindo-gun, Jindo-gun, Jindo-gun, with only one time the victim’s right jum in front of the said main store.

B. On October 11, 2014, the Defendant: (a) around 19:30 on October 11, 201, at the victim’s right side of the victim who singing in order to sing in a singing room 3, 201.

Accordingly, the defendant committed an indecent act on the part of the victim twice.

2. 폭행 피고인은 2014. 10. 11. 20:00경 위 유흥주점에서 일행인 F이 제1항 기재와 같은 피고인의 추행장면을 보고 피고인에게 “넌 왜 형수님에게 함부로 행동하냐”라고 말하며 그곳에 있던 무선마이크로 피고인의 뒤통수를 ‘툭’ 쳤음에도 피해자가 피고인을 때렸다고 억지를 부리며 피해자에게 “씨발, 좆 만한 년이 날 때려”라며 욕을 하고 무선마이크 1대를 바닥에 집어 던졌고, 피해자로부터 왜 마이크를 집어 던지냐는 항의를 받자 피해자가 들고 있던 마이크를 빼앗아 피해자에게 “마이크 멀쩡한데”라고 말하며 위 마이크로 피해자의 입술부위를 1회 때려 폭행하였다.
