A defendant shall be punished by imprisonment for three years.

The defendant shall obtain money from the defendant to C who is an applicant for compensation 28 billion won or more, and shall obtain money from D.

Punishment of the crime

The defendant committed as if he gets a large amount of profit through the substitute loan business, and felling the victim D and the victim C, who is a part of society, and made the victims obtain a debt, and made them continue to pay money under the name of investment or loan, and received the money by fraud.

1. On April 19, 2012, the Defendant against the victim D made a false statement to the victim D at “G” coffee shop located in Gangnam-gu Seoul EF Station, stating that “I will make a substitute loan business at H where I work within, and make an investment, 5% to 10% per month, and return the principal at any time if I talk before one month.”

However, the facts were that the defendant was not H employee, that he did not run a substitute loan business in H, and that the defendant's living expenses, card price, entertainment expenses, etc. were received money from the victim.

As such, the Defendant deceptioned the victim, and received KRW 3 million from the victim on April 20, 2012 to the head of the Tong on April 20, 2012. From this point to March 7, 2014, the Defendant deceivings the victim over 23 times in the same manner as shown in attached Table 1, and received a total of KRW 385 million from the victim.

2. On November 20, 2012, the criminal defendant against the victim C made a false statement to the victim C at the “J” coffee shop located in the Jung-gu Government City I, i.e., the victim C to pay 5% interest per month if he/she lends money to it, and to pay the principal at any time if he/she talks before the month.

However, the fact was that the defendant did not operate a substitute loan business through the SC bank, and the defendant's living expenses, card payments, entertainment expenses, etc. received money from the victim.

As such, the Defendant deceivings the victim as such, and 30 million won is the head of the Tong on the same day from the victim.
