1. The Defendant’s KRW 28,100,000 as well as the Plaintiff’s annual rate of KRW 5% from June 1, 2011 to August 21, 2015.
Reasons
1. The plaintiff alleged that he lent 13,000,000 won in total to the defendant upon the request of the defendant for a loan from the defendant for living expenses and deposit money, and the plaintiff argued that the loan from November 6, 2009 to the defendant was KRW 50,000,00 as shown in the following table. The plaintiff argued that the loan from November 6, 2009 to the defendant was KRW 60,000,000,000 in cash from the preparatory documents of June 19, 2015 stated on the date of the seventh pleading, which was around November 6, 2009. The plaintiff argued that the defendant lent 23,00,000 won in cash to C and D designated by the plaintiff, and that the plaintiff received 7,00,000,000 won in cash after receiving 7,000,000 won in cash from the defendant's loan to the above KRW 30,000,00 in total.
Accordingly, the argument that the remainder except KRW 30,000,000 is a loan is withdrawn. In addition, it appears that the defendant has withdrawn the argument that the sum of the money that the plaintiff made to transfer to C, D, etc. and the sum of KRW 30,000,000 directly received by the plaintiff was paid as a repayment, and the defendant also asserts that the money transferred to C and D as above is not paid as a repayment for the loan.
Since March 6, 2009, KRW 31,900,000, KRW 30,900 on March 30, 2009, KRW 17,000 on March 30, 200, and KRW 17,000 on December 2010.
Of the remainder of loans, 91,100,000 won, excluding the amount already repaid by the Defendant, the Plaintiff changed the cause of the claim as seen in Section 1), and there was no change in the purport of the claim in line with the changed cause of the claim. The Defendant is obligated to pay damages for delay.
