Punishment of the crime

【The Defendant was sentenced to a suspended sentence of ten months of imprisonment on June 24, 2015 due to an injury in the Daegu District Court racing support, etc., and the judgment was finalized on July 2, 2015. On September 16, 2015, the Defendant was sentenced to a suspended sentence of two years of imprisonment on September 24, 2015 and the judgment became final and conclusive on September 24, 2015.

[Criminal Facts]

1. No person who violates the Act on the Promotion of Utilization of Information and Communications Network and Information Protection, etc. shall allow anyone to reach other persons repeatedly in the form of code, text, sound, image, or picture creating fear or apprehension through an information and communications network;

Nevertheless, around May 3, 2015, the Defendant sent the victim’s cell phone text message “Chewing sway and sea” to the victim’s cell phone using the Defendant’s cell phone (D) and sent the victim’s cell phone text message at around seven times in total, including from around that time until September 13:56, 2015, on the ground that the victim C took away a female who was the Defendant’s abstinence in the past.

Accordingly, the Defendant repeatedly reached the victim with the language that arouses fear or apprehension through the information and communications network.

2. On September 27, 2015, the Defendant: (a) discovered that the victim is waiting in front of the signal counter while driving a cab and stopping in front of the signal counter on the top of the racing bus terminal located in the Simn-si, Young-si on the same ground as the indicated in paragraph 1 on September 13:30, 2015; (b) set the victim’s bath to “Im Mae Mae Mae Mae Mae Mae mae mae mae mae mae ma mae mae mae mae mae mae mae mae mae mae mae mae mae mae mae mae mae ma
