1. The sentence against the accused shall be determined by a fine of eight million won;

2. The defendant does not pay the above fine.

Punishment of the crime

The Defendant is a person who had a relationship with C from December 2, 2009 to August 2015, and the victim D is a legal action of the said C.

1. Intrusion upon residence;

A. On August 2012, the Defendant, at the victim’s house located in E Apartment No. 303, 1503 at the permanent residence of around August 2012, the victim intruded into the victim’s home with a view to engaging in sexual intercourse with C, and sexual intercourse with C, which is the husband of the victim.

Accordingly, the defendant invadedd the victim's residence against the victim's will.

2. No person who violates the Act on the Promotion of Utilization of Information and Communications Network and Information Protection, etc. shall distribute any information that leads to fear or apprehensions through any information and communications network, with a content that reaches other persons repeatedly;

Nevertheless, on August 21, 2015, the defendant is the victim D's cell phone using the defendant's cell phone from a member of a permanent resident city around August 21, 2015, and the period of validity of reporting sexual assault is ten years.

”, “ 알아서 해”, “ 자꾸 지랄 하믄 가만 안 있을 껴”, “ 편지에도 있다시피 당신 남편 내게 술 퍼먹이고 모텔로 끌고 가서 성폭행한 거 알어” 라는 등 공포심이나 불안감을 유발하는 문자 메시지를 전송한 것을 비롯하여 그 무렵부터 2016. 11. 16. 경까지 별지 범죄 일람표 기재와 같이 총 32회에 걸쳐 피해자의 휴대전화에 문자 발송, F 메시지 발송 및 웹사이트 문자 메시지 발송 등의 방법으로 공포심이나 불안감을 유발하는 문언을 반복적으로 피해자에게 도달하게 하였다.
