A defendant shall be punished by imprisonment for not more than ten months.

Punishment of the crime

around 10:00 on December 10, 2013, the Defendant called the victim D(36 years of age) in Seo-gu, Seo-gu, Daegu-gu, that “The Defendant would transfer 49 million won to the Plaintiff a letter of resignation on December 10, 2013.”

However, even if the defendant received money from the victim, he did not think that he would purchase BMW vehicle, and he would have consumed all of the defendant's personal purposes.

Ultimately, the Defendant, by deceiving the victim as such, received 49 million won from the victim to the post office account under the name of the Defendant at around 13:44 on the same day as the purchase price for vehicles.

Around May 20, 2014, the Defendant called “(2015 Highest 1149)” to G, which opened a FTT car on the Internet as a good, called “A person who purchases a vehicle without any condition to purchase the vehicle.” After again called “A person(36 years of age) to the victim H(36 years of age) who had ordinary trading relationship, the Defendant made a false statement to the Daegu Highest 27,300,000 won, and the vehicle price would be immediately transferred to the account in the city.”

However, in fact, the defendant was in the middle and high-speed sales company, and the damage was caused by the debt demand in consideration of the damage, and even if he was paid the vehicle price from the victim, he did not have any intent or ability to cause the above passenger vehicle to buy and sell the vehicle.

On June 2, 2014, the Defendant: (a) by deceiving the victim; (b) caused the victim to check the above merger in front of the JA car agency located in Daegu Suwon-gu I; and (c) obtained transfer of KRW 27,300,000 to the Defendant’s post office account; and (d) acquired the victim by deception.

The Defendant called the Victim K(39 years of age) on July 24, 2014 and called the Victim K(39 years of age) on July 24, 2014.
