1. Occurrence of liability for damages;

According to the above recognition of liability, the Plaintiff, a passenger of the Defendant, sustained an injury while getting off the Defendant’s vehicle, and thus, the Defendant, a mutual aid business operator, is liable to compensate the Plaintiff for the damages caused by the instant accident.

However, as seen earlier, the Plaintiff erred by sending off the left portion to India and completing almost down the left part of the Defendant’s vehicle, leaving it back again, and trying to contact the transportation card on the Defendant’s terminal in an unreasonable manner. As such, the Plaintiff’s error also seems to have caused damage or expansion, and thus, the Defendant’s liability is limited to 70% in calculating the amount of damages to be paid by the Defendant.
