A defendant shall be punished by imprisonment for one year and a fine of 6,00,000 won.

However, the above imprisonment for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

"2019 Highest 602"

1. The Defendant is a person engaging in driving service of BK5 vehicles.

On December 21, 2018, the Defendant driven the above car on December 21, 2018, and led to the two-lane road in Part C of the Seoul Southern-gu, Seoul to proceed along the same one-lane from the original air basin to the ethic air basin.

Since there is a place where separation has been installed, there was a duty of care to safely drive along his own car line by putting on the front side as a person engaged in driving of a motor vehicle, and accurately operating the steering wheel and brake system.

Nevertheless, the Defendant neglected this and neglected to take measures, such as immediately stopping and reporting, so that the central separation zone was received, and the repair cost equivalent to approximately KRW 660,000,00 was damaged by negligence, while neglecting the duty of care in the front bank.

2. Violation of the Road Traffic Act (Refusal of Drinking Measures) was demanded by the Defendant to respond to a drinking test by putting the Defendant into a drinking measuring instrument for about 15 minutes on the ground that there are reasonable grounds to recognize that the Defendant driven the above K5 vehicle while drinking the vehicle at the time and place specified in paragraph (1) and caused a traffic accident, such as Paragraph (1), and due to the occurrence of a traffic accident as set forth in paragraph (1).

Nevertheless, the Defendant did not comply with a police officer’s request for measurement of drinking without justifiable grounds, by clearly stating his/her intention to refuse to measure drinking.

3. Around December 21, 2018, the Defendant violated the Road Traffic Act (unlicensed Driving) and driven BK-5 cars without obtaining a driver’s license from around 1km section from the friendly Non-Road in Gangnam-gu, Seoul to the Seoul Northern-gu C road.
