Defendant

A shall be punished by imprisonment for ten months.

However, with respect to Defendant A, the above punishment shall be imposed for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

Defendant

A is the representative of the G Care Center, a re-long-term care institution located in F at the time of the Gyeonggi-do Government, and the defendant B is the doctor who operates the I Hospital located in H at the Namyang-si.

1. On May 11, 201, Defendant A established the G Care Center and received the expenses for long-term care benefits from the care workers belonging to the said Center via the bank account in the name of the said Center (J) around the 25th day of each month, when the care workers belonging to the said Center visit the home of the aged, who were classified as the elderly suffering from dementia, etc. under the Long-Term Care Insurance Act and the Welfare of Older Persons Act (hereinafter “beneficiary”), and submitted the details of the services, such as physical activities, family activities and bathing, i.e., providing home care benefits, and entering the details thereof in the record of providing long-term care benefits, Defendant A’s fraud, based on this, filed a claim for expenses for long-term care benefits by accessing the home on the Internet homepage of the Seocho National Health Insurance Corporation (hereinafter “victim”). On the 25th day of each month, Defendant A received the expenses for long-term care benefits from the victim to the care workers belonging to the said Center as allowances for care workers

On February 2, 2012, the Defendant: (a) took advantage of the fact that the Victim’s Service did not properly examine the details of the record book of the provision of long-term care benefits and paid expenses for long-term care benefits as claimed by the Center; (b) provided the beneficiary with home care benefits or home care benefits; (c) provided the beneficiary with home care benefits; (d) provided the beneficiary with home care benefits; and (e) provided the beneficiary with home care benefits; (e) provided at least 60 minutes of home care benefits, at least two caregivers provided home care benefits, even if one caregiver provided home care benefits.
