A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The defendant is the representative director of the Dispute Resolution Co., Ltd. in Busan Metropolitan City, and the victim D (the victim, 20 years of age) is a person employed from November 21, 2016 to November 4, 2019 and in charge of accounting affairs.

1. Crimes on November 6, 2018

A. In November 5, 2018, from around 18:30 to around 20:30 of the same day, the Defendant, a quasi-indecent act by compulsion, took the victim from around 21:0 on the following day: (a) around around 21:0 of the same day: (b) around 21:00 to around 20:0, the Defendant, along with the victim, she her drinking together with the victim at the “F” restaurant and the packing end in the vicinity of the said restaurant; and (c) took the victim’s her part in the road.

At around 04:00 on November 6, 2018, the Defendant met the victim by facing the victim, who was under the influence of alcohol and was not able to resist due to the victim’s failure to resist, so that the victim’s sexual organ is in a negative part of the victim, and the victim has her eye with the victim’s son’s son, and had the victim her son’s son, and had the victim her son’s son’s son with the victim’s son.

Accordingly, the Defendant committed an indecent act against the victim by taking advantage of the victim’s state of difficulty to resist.

B. Around 05:00 on November 6, 2018, the Defendant committed an indecent act by compulsion by force against a victim, who was on board in front of the “J” convenience store located in Sinsan City I. However, when the victim refuses to do so, the Defendant committed an indecent act by compulsion by force against the victim by making the victim kiscing the victim by making the victim kiscing his/her own hand so that he/she could not leave the victim by making the victim kiscing him/herself.

C. On November 6, 2018, the Defendant violated the Act on Special Cases Concerning the Punishment, etc. of Sexual Crimes (Indecent Act on the Abuse of Occupational Authority, etc.) said that, around 07:30 on November 6, 2018, the Defendant would leave the victim to the company in the vicinity of the above “J” convenience store, while leaving the victim in his/her workplace and moving the victim to the company.
