피고인은 2015. 1. 17. 20:30경 울산 남구 B에 있는 C지구대 주차장 내에서 자신의 폭행 사건을 잘 처리해 주지 않는다는 이유로 112순찰근무를 나가기 위해 순찰차량(D) 운전석에 탑승 중이던 울산남부경찰서 C지구대 소속 경찰공무원인 경사 E에게 다가가, 주먹을 들어 운전석 유리창에 들이대며 "야 십할놈아 내려봐라 씹새끼야, 야이 짜바리새끼야 왜 쫄리나"라고 욕설을 하고, 운전석 유리창을 6-7회 가량 발로 걷어차고, 운행하려는 순찰차량 앞을 가로 막는 방법으로 경찰공무원의 112 순찰근무에 관한 정당한 공무집행을 방해하였다.
