The judgment of the court below is reversed.

The defendant is innocent. The summary of this judgment shall be notified publicly.

Reasons

1. The summary of the grounds for appeal is that the defendant, as a DNA, refused to enlist in the military according to his religious conscience and has justifiable grounds under Article 88(1) of the Military Service Act.

Nevertheless, the lower court erred by misapprehending the legal doctrine, thereby adversely affecting the conclusion of the judgment.

2. On August 23, 2016, the Defendant issued a notice of enlistment for active duty service in the name of the director of the Chungcheong Military Manpower Office to enlistment in the area of the person to be enlisted in the active duty service, in the Defendant’s residence located in ASEAN-si B, and in the 37 group located in Chungcheongnam-si, Chungcheongnam-si, Chungcheongnam-si by e-mail to October 11, 2016, but did not enlist without justifiable grounds for three days after the date of enlistment.

3. Determination
