피고인은 2013. 8. 27. 03:55경 서울 관악구 B 노상에서 택시요금을 지불치 않는다는 112신고를 받고 출동한 경찰관인 피해자 C(47세)에게 택시기사 D, 행인 E 등이 보는 가운데 “임마 새꺄 까불지마 어디서 개새끼가 이 전라도 새끼가”라고 하여 공연히 피해자를 모욕하였다.
