1. 공소사실의 요지 피고인은 2018. 10. 6.경 장소를 알 수 없는 곳에서, 총 9명이 이용하는 B 단체 대화방에 피해자 C과 시비가 되어 다툼을 하던 중, 피해자의 사진을 전송하면서 피해자를 지칭하여 ‘누가 먼저 시비 걸었는지 보셈 이 씨발 애미 처 뒤진 년아ㅋㅋ’, ‘술 먹으러 가는게 아니라 몸 대주러 가는 거 아니고 ㅋㅋ’, ‘시발 개보지년이 왜이리 못생겼노’, ‘그러면서 지가 이쁜 줄 알고 처 지랄이야 개 씨발 창년이ㅋㅋ’,‘오크년' 등의 내용을 전송하여 피해자를 공연히 모욕하였다.

2. The offense of insult is subject to prosecution (Article 312(1) of the Criminal Act). According to the record, the victim’s revocation of complaint to the court on January 2, 2019, which was after the institution of public prosecution.

Therefore, the prosecution of this case is dismissed in accordance with Article 327 subparagraph 5 of the Criminal Procedure Act.
