A defendant shall be punished by imprisonment for two years.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant was sentenced to a suspended sentence of three years on July 26, 2012 by imprisonment with prison labor for a violation of the Act on the Control of Narcotics, Etc. at the District Court on July 26, 2012, and the said judgment became final and conclusive on August 3, 2012.

2. On March 15, 2012, the Defendant: (a) around 17:20 on March 15, 2012, sold 70,000 won from I for the purchase price of penphones; (b) around 17:20 on March 15, 2012, sold approximately 0.7 grams of penphones.

3. On March 18, 2012, the Defendant: (a) around 13:00 on March 18, 2012, sold 70,000 won from I for the purchase price of phiphones; and (b) sold approximately 0.7 grams for phiphones in the same place as above 13:00 on March 18, 2012.

4. On March 19, 2012, the Defendant: (a) around 22:30 on March 19, 2012, sold 70,000 won from I for the purchase price of penphones; and (b) sold approximately 0.7 grams for penphones in the same place as the above paragraph (1).

5. On March 25, 2012, the Defendant: (a) around 17:30 on March 25, 2012, at the same place as the above paragraph 1, 70,000 won from I for the purchase price of phiphones; and (b) sold approximately 0.7 grams of phiphones.

6. On March 27, 2012, the Defendant: (a) around 21:00 on March 26, 2012, on the road front of K Hospital located in Gangdong-gu Seoul Metropolitan City, 200,000 won as the purchase price for philon from I; and (b) around 03:00 on the following day, the Defendant sold 5g of philon to I in the vicinity of M in Gwanak-gu Seoul Special Metropolitan City.
