1. Basic facts

A. The Plaintiff purchased the CJ 2,007 square meters (hereinafter “instant land”) from Nonparty F Co., Ltd. (hereinafter “Nonindicted clan”) and completed the registration of ownership transfer on June 23, 2017.

B. G entered into a lease agreement with the non-party clan with respect to part of the instant land for the purpose of owning 43.85 square meters (107 square meters in the register, and the actual area in the register) of the 1st floor of the housing of 43.85 square meters (107 square meters in the registry) of the instant land at the time of the strike of the land

C. On December 22, 2010, the Defendant purchased the said building from G to KRW 20 million, and at the same time acquired the said right of lease, and completed the registration of ownership transfer on the said building on January 7, 201.

On the instant land, the part used by the Defendant is one of the KRW 168 square meters in the ship that connects each point of 28, 29, 30, 31, 32, 33, 34, 35, 36, 25, 37, 38, 39, 40, 41, 42, 43, 46, 49, and 28 of the annexed drawing 1.
