A principal lawsuit and a counterclaim shall be deemed simultaneously.

1. Facts of recognition;

A. On February 8, 1924, the Defendant’s attached D completed the registration procedure for transfer of ownership on the ground of sale on December 2, 1923 with respect to the forest land of 8,727 square meters in Seocheon-gun, Chungcheongnam-gun, Chungcheongnam-do.

On June 1, 1994, the defendant completed the registration procedure for transfer of ownership by inheritance on April 9, 1970.

The area of the real estate injury was 7,586 square meters due to the boundary revision on February 16, 2016.

On the other hand, on June 17, 1965, the plaintiff's attached E completed the registration procedure for transfer of ownership on the ground of sale on December 9, 1956 with respect to the land of 2337 square meters that is adjacent to the defendant's land.

On April 16, 1998, the plaintiff completed the registration procedure for transfer of ownership based on inheritance by consultation and division on April 16, 1997.

The above land was partially partitioned on August 3, 1999 and its area became 2334 square meters.
