Defendant shall be punished by imprisonment for not less than two years and six months.
However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. Violation of the Act on the Protection of Children and Juveniles against Sexual Abuse against Victims C (production, distribution, etc. of obscene materials);
A. On May 10, 2014, from around 13:00 to around 14:15 of the same day, the Defendant: (a) taken a photograph of the victim C (Wanon EOS 650D) using a camera (a model name: Canon EOS 650D) in a D-based street room located in Seoul and below Seoul; and (b) made it possible to store the Defendant’s video files and video files as shown in the Defendant’s video files and video files (IG) with the Defendant’s house located in attached Form 302 of the 11:30 of the same month, which expressed the contents of sexual acts, such as pictures of the victim, the victim’s legs, and the cro business technique.
As a result, the Defendant produced obscene materials for children and juveniles.
B. On June 9, 2014, the Defendant received KRW 50,000 from the Defendant’s home located in the preceding paragraph at around 20:35:18, from the Defendant’s home, and sent KRW 50,000 to the e-mail (F) using the Defendant’s non-name files of the attached crime No. 180 per annum No. 180 of the sight list 1 of the attached crime in which C’s sexual act expression is recorded at around 21:14 of the same day.
Accordingly, the Defendant sold child or juvenile pornography for profit-making purposes.
2. Violation of the Act on the Protection of Children and Juveniles against Sexual Abuse against Victims G (production, distribution, etc. of obscene materials);
A. The Defendant, from around 11:40 on July 8, 2014 to 12:03 on the same day, expressed the content of sexual acts, such as pictures, etc. taken by the victim G (the age of 17) using the camera in the mutual insular distance room in Gangnam-gu Seoul, using the Kameras described in paragraph (a) using the Kameras, thereby putting the victim G (the age of 17) with his/her uniform and walking the Kameras in his/her body.
