Punishment of the crime

[2013 Highest 4540] The Defendant came to know that C, D, etc. recruited persons who did not obtain a loan due to low credit rating, had them obtain a credit card under the name of the lending requester, and then had them obtain a credit card for a certain period by raising the credit card transaction performance, and then purchased high-priced automobiles with such credit card for a certain period, and sold them or received a large amount of cash service and did not pay credit card payment, instead of selling it, the Defendant issued 70% of cash prepared by the above method to the lending requester and arranged a loan by acquiring C, etc.

On October 10, 2010, the Defendant requested the above D and E to arrange a loan at a coffee shop where it is impossible to know the trade name near the Seocho-gu Seoul Special Metropolitan City bank, the Defendant issued one credit card (F) in the name of the Defendant according to D and E’s instructions, and around July 13, 201, issued three credit card banks (credit card number: G, H, and I) in the name of the Defendant.

The above C, D, and E used four credit cards in the name of the Defendant from the early October 201 to February 201, the credit card limit was set by settling the credit card payment normally by using four credit cards in the name of the Defendant.

The Defendant, as above, conspired with the above C, D, and E in sequence, did not have an intent or ability to pay the credit card price normally even when using the credit card issued by Korea Bank Co., Ltd., the Defendant: (a) on February 25, 201, when the credit card price was increased due to the increase in the actual use of the credit card; (b) on February 28, 201, the Defendant received 1.5 million won cash service from the above bank (credit card number:F) in the name of the Defendant at “K” on the 10th floor of Gangnam-gu Seoul J. 2
