A defendant shall be punished by imprisonment for not more than ten months.

Punishment of the crime

1. The Defendant of the public invitation with C and D from June 2009: (a) recruited persons who have been under credit rating with C (2 years and June 28, 2012) and D (2) with low credit rating and do not have good credit; (b) prepared an application for subscription to a credit card in the name of the applicant as if the applicant is in service with an enterprise that is merely registered as a business operator and does not actually engage in business (hereinafter referred to as “YA”); and (c) issued a credit card in the name of the applicant after counting the credit card transaction performance for a certain period after counting the credit card lending limit; and (d) obtained a large amount of loans at one time to the applicant for the loan; and (e) offered the remainder as a service fee.

In this regard, C plays a role of raising the transaction performance with the passbook of the nominal owner of the credit card and the credit card, D, by means of this method, soliciting the nominal owner of the credit card loans, and the defendant would play a role of enhancing the amount used by counseling with the person in charge of the credit card company.

A. On Oct. 1, 2009, the part of the applicant E for a loan (determined to KRW 7 million on Mar. 1, 2013) requested the said Defendant, etc. to apply for a loan, and the Defendant, along with C and D, prepared a false credit card application as if E were in office in F, a responsible company, with C and D, and made a credit card limit by continuously using the credit card and paying the amount normally by paying the credit card.

On March 19, 2010, the Defendant conspired with C, D, and loan applicants E, and on March 19, 2010, borrowed KRW 3,000,00 with the credit card in the above E’s bank even if the Defendant used the credit card issued by the Korean bank as the injured party did not intend or have an ability to pay the credit card normally.
