Reasons

1. Basic facts

A. On August 31, 2004, the Defendant requested the Plaintiff to take a minor disciplinary measure against C pursuant to Article 54(3) of the Private School Act on the ground that the Plaintiff’s entrance management director of B University, who was operated by the Plaintiff, wrongfully executed the school expenses.

B. On July 12, 2012, the Defendant: (a) on the ground that the president of the B University operated by the Plaintiff, D; (b) the professor of applied information statistics department (former Vice-President); (c) the Vice-President F; (d) the professor of industrial design department (former Planning Department); and (c) the planning director unfairly paid the individual pension charges to be paid by the H teachers and staff at the school expense; and (c) the entrance officer unfairly executed the entrance expenses by the I, pursuant to Article 54(3) of the Private School Act, the Defendant demanded the Plaintiff to take serious disciplinary action against D, E, F, G, H, and I, respectively.

C. On August 20, 2013, the Defendant ordered the Plaintiff, pursuant to Article 60(2) of the former Higher Education Act (amended by Act No. 12036, Aug. 13, 2013; Act No. 12036, Feb. 14, 2014); on the ground that the Plaintiff failed to comply with each of the above requests for disciplinary action without justifiable grounds, to suspend the Plaintiff from recruiting new students during the year 2014 from the recruitment of new students, equivalent to 5% of the fixed number of new students.
