A defendant shall be punished by imprisonment for not more than ten months.

Punishment of the crime

On September 24, 2013, the Defendant was sentenced to imprisonment with labor for a violation of the Petroleum and Petroleum Substitute Fuel Business Act at the Incheon District Court on September 24, 2013, and is currently pending in the appellate trial.

(2013No2938) The Defendant, along with AH and AI, will operate the “AK station” located in the Western-gu AJ in Western-si, Western-si, Western-si. The Defendant directly is responsible for the operation of the gas station through the orders of oil and employees management. AH and AI shall invest the gas station deposit and operating funds, and shall report the status of operation of the gas station from the Defendant from time to time. AL manages the gas station on behalf of AH and AI, and AM shall work as the gas station, while D and C share their roles with each other.

1. No petroleum retailer shall install or remodel business facilities for the purpose of manufacturing fake petroleum products, or acquire or rent and use business facilities installed or remodeled therein;

Nevertheless, on April 23, 2012, the Defendant installed and remodeled business facilities without permission to manufacture and sell fake petroleum, such as installing a secret pipeline connecting a distribution machine with a tank to store a fake petroleum, through the funds received from AH at the above AK oil station, and installing and remodelling it into the underground at the bottom of the state of alcoholic beverage 8, 1, 2, 5, and 5 (in cases of regulating the operation of a container, it shall be controlled that fake petroleum will come out of a state of alcoholic beverage), and a distribution machine and a distribution pipe (in cases of controlling the sale thereof, it shall be controlled that the normal product comes out of a state of alcoholic beverage).

Ultimately, the Defendant conspired with AH, AI, AL, AM,N, AO, and AP to install and remodel business facilities for manufacturing and selling fake petroleum products.

2. A petroleum retailer shall not install or remodel business facilities for the purpose of selling less than the fixed quantity beyond the used cars (±0.75%), or acquire or rent and use business facilities installed or remodeled therefor.
