A defendant shall be punished by imprisonment for not less than three years and six months.

Punishment of the crime

1. At around 03:20 on August 15, 2020, the Defendant: (a) discovered the victim D(22 years old) in which he was reporting a cell phone at the cump in front of the “Cump,” where the Defendant, located in Ansan-si B, and was living in his house; (b) prevented the victim from breaking the victim’s neck on his hand by cutting down the victim’s neck into the humb by cutting down the hum on the hump; and (c) cut off the victim’s humb by hand; and (d) cut off the victim’s 1.2 million won at the gallon-si’s market price owned by the victim’s grandchildren.

As a result, the defendant took the victim's property by force, and suffered an injury such as a tension for about 10 days in need of medical treatment.

2. The Defendant is a foreigner of Uzbekistan nationality in violation of the Immigration Control Act.

A foreigner may sojourn in the Republic of Korea within the limits of his/her status and period of sojourn, and in violation of this, he/she shall not sojourn outside the scope of his/her status or

Nevertheless, the Defendant entered the Republic of Korea as a visiting employment (H-2) on April 7, 2017, and stayed beyond the scope of the period of sojourn by failing to depart from the Republic of Korea after June 19, 2020, the expiration date of the period of sojourn, and staying in the Republic of Korea until August 17, 2020.
