1. On October 20, 2014, the Defendant rendered a decision that constitutes a person of distinguished service to the State on the ground that the Plaintiff fell short of the grade criteria.
Reasons
1. Details of the disposition;
A. On June 2, 1994, the Plaintiff was discharged from military service on February 13, 1995 while serving as gambling soldiers at the Army.
B. On January 4, 1995, the Plaintiff completed a shock training on October 194, and was subject to the 5th century (hereinafter “the first operation”) and the first operation on the following grounds: (a) during the period during which the Plaintiff was running a gambling and return gambling in the Giri-Sari; and (b) during the period during which he was running the gambling and return gambling.
C. On September 2, 2009, the Plaintiff applied for the registration of persons who rendered distinguished services to the State by applying for the 5th century-1,000 escape certificate (hereinafter “instant wounds”), and deliberated and decided on September 2, 2009 by the Board of Patriots and Veterans Entitlement to meet the requirements for soldier or policeman wounded on duty, but was determined to fall short of the grading criteria as a result of the new physical examination on October 29 and the reexamination on December 14, 2009 for the determination of the disability rating.
Since then, on March 6, 2014, the Plaintiff saw her pains, and received an operation manual from B Hospital as the 4th century-5th century on the medical records, and applied for the registration of a person who rendered distinguished services to the Defendant on March 24, 2014 again to the Defendant on March 24, 2014. On June 19, 2014, the Board of Patriots and Veterans (hereinafter “the Act on the Honorable Treatment and Support of Persons, etc. of Distinguished Services to the State”), but did not meet the requirements under the Act on the Support of Persons, etc. of Distinguished Services to the State (hereinafter “the Act on the Honorable Treatment and Support of Persons, etc. of Distinguished Services to the State”), but deliberated on and decided that the Plaintiff constituted a soldier or policeman under the Act on the Support for Persons of Distinguished Services to the State
Meanwhile, as a result of the re-verification physical examination conducted on September 5, 2014, the Daejeon Veterans Hospital presented that the Plaintiff’s instant wounds constituted Grade 7 (Classification No. 6109) of the disability rating. However, the Board of Patriots and Veterans on October 15, 2014, which was recognized as a soldier, police officer, did not meet the criteria for disability rating as a result of the review of film data and the results of the physical examination conducted by a medical specialist in the relevant specialized department.
