피고인은 2019. 7. 25. 19:17경 안동시 B에 있는 C슈퍼 앞 노상에서 '젊은 놈이 욕을 한다.'라는 신고를 받고 출동을 한 피해자인 경북안동경찰서 D지구대 소속 경위 E가 왜 욕을 하였느냐고 물어본다는 이유로 “야이 개새끼, 씹새끼야, 목 따 분다, 경찰관 십새끼, 날렸불라, 씹할놈아, 개새끼 씹할놈아, 이 씹할놈아, 개새끼, 확 쪼시 뿐다, 이 자슥아“라고 말하여 F 등 3명이 있는 가운데 공연히 피해자를 모욕하였다.
