A defendant shall be punished by imprisonment for not less than one year and six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

피고인은 위와 같은 이유로 같은 날 08:50경부터 08:52경까지 위 순천역 앞 도로에서부터 순천시 풍덕동에 있는 홈플러스 앞 사거리에 이르는 편도 3차로 도로에서 위 BMW 승용차를 운전하여 2차로를 따라 진행 중인 피해자 D 운전의 위 택시 앞으로 끼어든 후 갑자기 속력을 줄이고, 피해자 D이 이를 피해 1차로로 변경하자 다시 1차로로 차선을 변경하면서 속력을 줄이며 앞을 가로막고, 피해자 D가 다시 이를 피해 2차로로 변경하자 재차 이를 따라 2차로로 이동한 후 속력을 줄여 그 앞을 가로막고, 이에 피해자 D가 대응하지 않고 다시 1차로로 차선을 변경하자 2차로에서 위 택시 옆으로 따라 붙어 차를 세운 뒤 피해자 D가 창문을 내리고 피고인에게 “내가 뭘 잘못해서 이러십니까 ”라고 묻자 인상을 쓰며 갓길 쪽으로 손짓을 하며 “차 빼, 빼.”라고 말하였다.
