1. Defendant A shall be punished by imprisonment with prison labor for a period of ten months.
However, the above sentence shall be executed for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
Defendant
A serves as the head of the overall team at the victim F Co., Ltd. (hereinafter “victim”) who is a motor vehicle parts manufacturer company, and is engaged in the management of the motor vehicle parts upon receiving orders from the customer B, which is the gold materials for the motor vehicle parts. Defendant B purchased approximately two times a year from the victim company as a person who operates the “G”.
Defendant
A receives an order from the Customer to deliver the “Dong” to the Company, and without delivering a part of them to the Company, he arbitrarily sells it, and Defendant B sells the “Dong” to the Company B, which is not a bad thing at once.
On the face of a truck, the truck will bring the "Dong" on the truck. Defendant B received the aforementioned proposal from Defendant A and knew that Defendant B sold the "Dong" of the victim company, but Defendant B borrowed the truck to transport the "Dong" to Defendant B and purchased it.
According to the above public offering, the Defendants: (a) around March 26, 2015, Defendant A kept one ton of the “Dong” in the market price of KRW 7 million for the said Company at the I’s I’s place of business located in Sungwon-si, Sungwon-si; (b) Defendant A operated the cargo vehicle from the first floor of the J-gu, Sungwon-si, Sungwon-si, Sungwon-si, to the said I’s place of business; (c) carried the said “Dong” into the said I’s place of business and returned to the first floor below the said J’s building; and (d) Defendant B embezzled the victim’s property by taking one ton of the said “Dong” from Defendant A and embezzled the victim’s property on June 14, 2017 through the same method as shown in the list of crimes in the attached Table 14 times.
