1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
Plaintiff
On April 21, 2015, the Plaintiff lent KRW 21,000,000 to C as interest rate of KRW 1,000,000 per month. On the death of C, the Defendant, a child, has solely inherited C’s obligations, and the Defendant is obligated to pay the Plaintiff the loan amount of KRW 21,00,000,00 and the delay damages.
Judgment
In a case where the holder of a title to the preparation of a private document recognizes the formation of a stamp image portion, barring any special circumstance, it is presumed that the holder of a title to the preparation of the document in question bears no signature or seal while the entire content of the document is completed, and the authenticity of the document in question is presumed to be established.
