A. 나. 공무집행방해, 상해 피고인은 2020. 4. 22. 01:50경 위 가항과 같은 장소에서 피해자 F이 피고인을 상대로 신고 내용에 대하여 진술을 청취하려 하자, “니가 뭔데 이런걸 물어보냐, 씹할놈아.”라고 욕설을 하며 손으로 피해자 F의 목을 1회 밀치고, 이에 공무집행방해 등 혐의로 현행범인 체포되어 순찰차에 탑승하게 되자 머리로 피해자 G의 코 부분을 1회 들이받고, 발로 피해자 F의 턱 부분을 1회 찼다.

계속하여 피고인은 같은 날 03:01경 광주 광산구 H에 있는 광주광산경찰서 E파출소 사무실에 인치되자 “씹할 놈들아 손목이 아프니까 수갑을 풀어주라”고 요구하여 피해자 F 등이 피고인의 수갑을 풀어주자, 오른발로 피해자 G의 명치 부분을 2회 찼다.
